This Privacy Policy explains how AppyKava LLC, doing business as HappyKava ("HappyKava," "we," "us," or "our"), collects, uses, discloses, and protects information when you use HappyKava's mobile applications, websites, owner and staff portals, public directories, widgets, communications tools, programs, and related services (collectively, the "Services").
This Policy applies to consumers, visitors, applicants, bar owners, managers, staff, drivers, merchants, advertisers, brand representatives, and other people who interact with the Services. Some features have additional notices presented when information is collected or a feature is used.
1. Information We Collect
The information we collect depends on which Services you use and the choices you make.
Account and profile information
We may collect your name, display name, username, email address, phone number, profile photo, home city, Home Bar, favorites, preferences, authentication provider, account identifiers, age or eligibility confirmation, and other information you add to your profile.
Authentication providers may give us limited account information according to your settings with them. If you enable biometric quick login, Face ID, fingerprint, passcode, or similar authentication is handled by your device; HappyKava does not receive your biometric template.
Business, staff, merchant, and advertiser information
If you represent a bar, brand, merchant, advertiser, or other business, we may collect business contact information, role and permission information, ownership or employment verification, bar claims, team membership, plan and billing status, support history, campaign materials, audiences, communications, operational actions, and audit records.
Merchant or payment-service applications may require legal business names, tax or registration information, beneficial-owner or representative information, identity-verification references, bank or settlement details, underwriting information, provider credentials, and related compliance records. Payment and verification providers may collect some of this information directly.
Location, travel, check-in, and presence information
With permission, we may process approximate or precise location to show nearby bars, plan TravelRoot trips, confirm check-ins or redemptions, prevent fraud, support optional auto check-ins, share Crew presence you deliberately enable, validate a delivery address, estimate a route, or support an active delivery assignment.
Optional background location may be used for background auto check-ins or active delivery-route updates after you enable the feature and device permission. Delivery location updates stop when the applicable assignment ends. Crew presence is shared only when you choose to share at a bar or within an eligible social experience; it does not publish raw GPS coordinates to other users.
We may also collect saved trips, route stops, route preferences, estimated travel times, saved addresses, address-validation results, delivery zones, assignment status, and related usage records.
Contacts, Crew, and social information
If you choose to use contact discovery or invitations, HappyKava may access contact names and email addresses or phone numbers you select or make available for that session. Contact candidates are processed locally and are not uploaded as an address book.
For privacy-preserving matching, identifiers may be normalized and cryptographically transformed before a match request. HappyKava stores keyed matching digests for verified identifiers rather than a copy of your address book. We may also process your discoverability choices, connections, blocks, invitations, meetup memberships, votes, reactions, presence choices, and social graph.
Messages, audio, and support communications
We collect messages, group or direct-chat content, voice messages, attachments, reactions, mentions, reports, and related metadata when you use communications features. If transcription or another voice feature is offered, audio and resulting text may be processed by HappyKava or a service provider to provide that feature.
We also collect information you send to support, respond to in surveys, submit through feedback tools, or communicate to a bar or other participant through the Services.
Content, media, and community activity
We collect Content you submit, including reviews, ratings, photos, videos, profile information, bar updates, menu information, events, jobs, reports, comments, public posts, stories, brand or organization information, content suggestions, and moderation appeals.
We collect related activity such as favorites, follows, votes, reactions, check-ins, redemptions, saved items, referrals, game activity, challenges, leaderboard results, prizes, loyalty activity, and participation in promotions.
Camera, photo-library, microphone, and file permissions are used only after you or your device permits access. You can change these permissions in device settings.
Job applicant information
If you use HappyKava Quick Apply or an applicant profile, we may collect your name, email address, optional phone number, city and state, experience summary, availability, cover note, resume or other application files, job and business identifiers, application snapshots, withdrawal, and hiring-status history.
Do not submit Social Security numbers, identity documents, medical information, background-check information, payroll information, protected-class information, or other highly sensitive data unless a future feature specifically requests it with an appropriate notice.
Orders, delivery, Shop, and transaction information
When you browse or purchase products or services, we may collect catalog activity, cart contents, order and line-item information, purchase and refund history, subscriptions, discounts, tips, taxes, recipient name, phone number, delivery or shipping address, delivery instructions, age confirmation, fulfillment status, support requests, and transaction identifiers.
For delivery, participating businesses and assigned drivers may receive the contact, address, instruction, and order information needed to fulfill the order. Driver tools may process profile, eligibility, shift, assignment, route, tender, support, and active-location information.
HappyKava and its payment partners may receive payment status, payment-method type or limited details, processor tokens, receipts, entitlement information, chargebacks, refunds, disputes, reconciliation, settlement, and fraud signals. HappyKava generally does not receive or store full payment-card numbers or security codes.
Gift card, KavaCash, wallet, credit, and reward features may create account balances, ledger entries, issuance, funding, redemption, settlement, payout, and adjustment records.
Device, analytics, advertising, and technical information
We automatically collect or receive device and browser type, operating system, app version, IP address, device and account identifiers, language, time zone, network information, referring pages, page and screen views, searches, taps, feature usage, ad impressions and clicks, attribution, notification status, errors, crashes, diagnostics, and security or fraud signals.
Where enabled, session-replay technology may capture how you interact with selected app or web screens, such as taps, navigation, layout, and technical context, to diagnose problems and improve the Services. We configure replay and analytics tools to limit or mask sensitive fields where supported. Do not enter sensitive information into a field that does not request it.
We use cookies, pixels, local storage, software development kits, and similar technologies. Some data may first be associated with a device or pseudonymous identifier and later linked to an account when you sign in.
Artificial-intelligence and automated processing
If you use an AI-assisted feature, we may process the prompt, files, images, menus, drafts, output, feedback, identifiers, and technical context needed to provide, secure, evaluate, and improve that feature. Content may be sent to an AI or infrastructure provider acting for HappyKava. Automated systems may also help classify content, detect abuse, create recommendations, or assist moderation and support.
2. Sources of Information
We collect information:
- directly from you;
- automatically from your device, browser, and use of the Services;
- from bars, owners, managers, staff, drivers, merchants, employers, advertisers, and other users;
- from authentication, payment, app-store, mapping, analytics, communications, point-of-sale, artificial-intelligence, and other service providers;
- from public websites, public records, business listings, licensed data, and partners; and
- when another person invites you, identifies you as a staff member or applicant, submits a report, or otherwise interacts with you through the Services.
3. How We Use Information
We use information to:
- provide, personalize, maintain, and improve the Services;
- create and secure accounts and manage roles, permissions, and entitlements;
- power discovery, maps, TravelRoot, Home Bar, recommendations, and alerts;
- support check-ins, presence, passes, rewards, loyalty, games, and fraud prevention;
- enable Crew, messaging, invitations, support, moderation, blocking, and safety;
- accept and route applications to hiring businesses;
- process orders, delivery, shipping, payments, subscriptions, refunds, stored value, and support;
- operate owner, staff, merchant, driver, advertiser, and admin tools;
- provide analytics, attribution, reporting, research, public aggregate statistics, and product improvement;
- select, measure, and manage advertising, sponsorship, and promotional content;
- provide AI-assisted and automated features;
- communicate service, security, account, purchase, feature, and promotional information;
- detect, investigate, prevent, and address fraud, abuse, security incidents, prohibited conduct, and technical problems;
- comply with law, enforce agreements, resolve disputes, and protect people, property, rights, and the Services; and
- create aggregated or de-identified information that cannot reasonably identify you.
4. How We Disclose Information
We may disclose information in the following circumstances.
Service providers
We use providers for hosting, databases, storage, authentication, analytics, session replay, maps, routing, address validation, payments, subscriptions, app distribution, notifications, email, customer support, communications, fraud prevention, security, content processing, artificial intelligence, and other operations. They may process information for HappyKava under contractual or other applicable restrictions.
Bars, businesses, drivers, and other transaction participants
We disclose information needed to provide an interaction you request. Examples include showing limited check-in or redemption information to authorized staff; giving an assigned driver delivery information; giving a seller an order; giving a bar operational messages; or providing transaction status to the relevant merchant.
Hiring businesses
When you apply through HappyKava, we disclose your application, contact information, resume, and related status information to authorized owners or managers of the hiring business. That business processes the information for its own hiring purposes and may have separate legal obligations or privacy practices.
Other users and the public
Information you choose to make public—such as a display name, profile photo, review, public post, rating, leaderboard result, business listing, event, job, or other public Content—may be visible to anyone and may appear in search engines, public APIs, exports, widgets, or partner surfaces.
Crew connections, meetup participants, or other eligible users may see information you share with them, such as profile information, messages, reactions, votes, plans, or presence at a bar. Blocking or deletion cannot guarantee removal of copies another person already received.
Advertising and measurement partners
We may disclose device, interaction, attribution, contextual, campaign, and conversion information to help deliver, measure, secure, and improve advertising or promotions. We do not sell personal information for money. Some privacy laws define "sale," "sharing," or "targeted advertising" more broadly; where an applicable activity falls within those definitions, we provide the notices and choices required by law.
Legal, safety, and business transfers
We may disclose information when we reasonably believe it is necessary to comply with law or legal process; protect safety, rights, property, or the Services; investigate fraud or abuse; enforce agreements; collect amounts owed; or respond to an emergency.
Information may be disclosed as part of a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, subject to appropriate protections and applicable law.
With your direction or consent
We disclose information when you request or direct us to do so, connect a third-party service, use a feature where disclosure is apparent, or otherwise consent.
We may disclose aggregated or de-identified information that cannot reasonably identify you.
5. Retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including providing an account or feature, maintaining security and audit history, completing transactions, resolving disputes, enforcing agreements, and meeting legal, tax, accounting, employment, or regulatory obligations.
Retention varies by data and context:
- account and profile information is generally retained while your account is active and for a limited period afterward;
- public Content may remain until removed, superseded, or no longer needed, including in backups or lawful archives;
- messages, reports, check-ins, redemptions, fraud signals, and operational logs may be retained to operate and protect the Services;
- job applications and resumes submitted through Quick Apply are generally retained for 400 days after the later of submission or the most recent hiring-status action, unless a legal hold or different legal requirement applies;
- order, payment, refund, settlement, stored-value, billing, and tax records may be retained for the period required for financial, legal, audit, dispute, and fraud-prevention purposes;
- active driver-location data is limited to the fulfillment and safety workflow, while bounded route or assignment records may be retained for support, audit, and disputes;
- contact candidates used for Crew matching remain on your device for the matching or invitation session, while privacy-preserving match digests and relationship records may remain until deleted, revoked, rotated, or no longer needed; and
- analytics, session replay, diagnostics, and backups follow configured retention schedules and may persist for a limited period after deletion from active systems.
We may retain information longer when required by law, a legal hold, fraud or security investigation, payment dispute, or protection of legal rights. We may de-identify information instead of deleting it when the resulting information can no longer reasonably identify you.
6. Your Choices and Controls
Depending on the feature and your location, you may:
- update account, profile, Home Bar, favorite, notification, messaging, presence, discoverability, and privacy settings;
- grant, limit, or revoke device permissions for location, background location, contacts, camera, photos, microphone, and notifications;
- choose which Content to submit and which eligible social information to share;
- block or report users and hide or report Content;
- unsubscribe from promotional email or use available notification controls;
- manage an app-store or third-party subscription through the provider that bills it;
- withdraw a job application, subject to required record retention; and
- request access, correction, deletion, or a copy of certain information.
Some processing is necessary to provide an account, complete a transaction, prevent fraud, comply with law, or operate a feature you request. If you disable required information or permissions, that feature may not work.
7. Account and Data Deletion
You can initiate account deletion in the HappyKava app through Settings. If you cannot access your account, email support@happykava.app from the address associated with it.
Deleting an account removes or de-identifies account information and associated personal Content that HappyKava is not required or permitted to retain. Some records may remain for the periods described above, including transaction, tax, billing, fraud, security, employment, moderation, dispute, legal-hold, backup, and audit records. Information already shared with a bar, hiring business, merchant, driver, another user, or third-party service may also be retained by that recipient under its own obligations.
Deleting your HappyKava account does not necessarily cancel a subscription billed by Apple, Google, or another provider. Manage the subscription through the billing provider to prevent future renewal.
8. U.S. Privacy Rights
Depending on where you live and whether an applicable law covers HappyKava's processing, you may have rights to:
- confirm whether we process your personal information;
- access and obtain a portable copy;
- correct inaccurate information;
- delete information;
- opt out of certain sales, sharing, targeted advertising, or profiling;
- limit certain uses of sensitive personal information;
- appeal a denied privacy request; and
- use an authorized agent to make a request.
To exercise a privacy right, email support@happykava.app with the subject "Privacy Request." Describe the request and the account or browser information needed to locate the relevant records. We may verify your identity and authority before completing it. We will not discriminate against you for exercising an applicable privacy right.
If we engage in processing that applicable law treats as a sale, sharing, or targeted advertising, we will provide an appropriate opt-out method and process legally recognized browser-based opt-out signals where required.
9. Security
We use administrative, technical, and organizational measures designed to protect information, including access controls, encryption in transit, private storage for sensitive files, role checks, logging, and abuse prevention. No system is perfectly secure, and we cannot guarantee that information will never be accessed, lost, altered, or disclosed improperly.
Protect your account credentials and devices, and contact us if you believe your account or information has been compromised.
10. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from a child under 13. If you believe a child under 13 provided personal information, contact support@happykava.app so we can investigate and take appropriate action.
Features involving age-restricted venues, products, offers, payments, employment, location, or promotions may have higher age requirements. We may request age or eligibility confirmation and limit access when appropriate.
11. International Processing
HappyKava is based in the United States. We and our service providers may process information in the United States and other countries whose laws may differ from those where you live. Where required, we use appropriate safeguards for international transfers.
12. Third-Party Services and Links
Third-party websites, apps, app stores, bars, merchants, employers, drivers, and services may have their own privacy practices. This Policy does not govern information they collect independently for their own purposes. Review their notices before providing information directly to them.
13. Changes to This Policy
We may update this Policy as our Services, practices, providers, or legal obligations change. We will update the date above and provide additional notice when reasonably appropriate for a material change.
